Terms of use

1. Subject matter and scope

These terms of use govern the use of Gymi-Trainer (the “service”), a practice app for children in the 4th grade that is run under this domain. By registering a family account the parents accept these terms.

2. The family's account

An account is created and kept by a parent or another person with parental responsibility. The child practises within this account and has no account of its own. During the beta, registration is possible only with an invite code.

3. No promise about grades or the child's school career

The service is an aid to practice. It replaces neither lessons nor the teachers' assessment. Estimated grades, the forecast of the grade average and gradings of answers — including those made with the help of AI — are non-binding guidance. The operator gives no warranty for grades, a Förderprognose or the recommendation for a secondary school.

4. Disclaimer

The service is provided as it is, without express or implied warranty. In particular, the operator gives no warranty for:

• the correctness and completeness of the tasks, solutions and gradings
• the uninterrupted availability of the service
• the fitness of the service for a particular purpose

Liability for slight negligence is excluded as far as the law permits.

5. Duties of users

• The parents themselves are responsible for the correctness of the data they enter.
• Access to the account and the PIN of the parent area are to be protected from third parties.
• The service may be used for private, non-commercial purposes only.

6. Availability

The operator strives for high availability of the service but cannot guarantee a particular uptime. Maintenance, technical faults or force majeure may lead to temporary interruptions.

7. Termination and deletion of data

The parents can delete the account permanently at any time in the parent area under “Settings”. With the deletion all stored data of the family is removed irrevocably. The operator may stop providing the service with reasonable notice; in that case the families will be informed in good time.

8. Applicable law and place of jurisdiction

The law of the Federal Republic of Germany applies. The place of jurisdiction for all disputes arising from or in connection with these terms of use is Berlin, as far as the law permits.

9. Changes

The operator reserves the right to change these terms of use. Changes are published on this page. Continued use of the service after changed terms have been published counts as consent.
